NFTs Qualify For Trademark Protection, Ninth Circuit Rules (theblock.co) 22

The Ninth Circuit Court of Appeals has ruled that NFTs qualify as "goods" under the Lanham Act, entitling them to trademark protection. The decision in Yuga Labs v. Ryder Ripps establishes that brand owners can sue NFT copycats with the same legal tools used against counterfeit sneakers or handbags.

  • NFTs will now be possible to tax. Sales tax/VAT would apply.

I thought this whole NFT thing dried up and died

    • It really shows just how useless and slow our government is. Making rulings on something that haven't been relevant for well over a year. You think at some point the courts would have said "look, guys. no one give 2 shits about NFTs anymore. The entire market crashed 93% since COVID. Maybe we stop wasting our time, and just let this thing die"

Not really, as we've seen the slower it is the more chance it has to take and strengthen roots. A despotic reigime that takes over quickly tends to be the easiest to remove. The one that has had years, if not decades to move their people into key positions will take a Herculean effort to dislodge.

Yes. Most people don't want a govt that changes every week, or only takes an hour to decide what the law should be.

        Government intentionally moves slowly.

If you want things to go fast, look towards China were complex cases can be tried in a single day.

        Though you should've seen what

Not as long as there is money to launder.
Wash Trades are the only reason NFT's ever had any value, and as long as they exist, NFT's will.

    • We need AI to bring blockchain to NFTs so some influences can make Tik Tok videos that can be discussed on X.

    • I thought this whole NFT thing dried up and died

Most NFT transactions were money laundering.

Once law enforcement figured that out, NFTs attracted unwanted attention, so the criminals moved on.

    • I hope note. I just had the printer make mine into pogs.

  • NFT is anything.

NFT's remind me of smoke. Try and grab smoke. Nothing there. Your just waving your hand in the air hoping that you grab onto something.

So how can a copy cat NFT be sued when the source NFT is just further smoke? NFT's are just pretending to be something.

You copied my nothing, I'm suing. I'm so angry.
