NSA Improperly Collected US Phone Call Data After Saying Problem Was Fixed (usatoday.com) 58

An anonymous reader quotes a report from USA Today: The National Security Agency improperly collected phone call records of Americans last fall, months after a previous breach that compelled the agency to destroy millions of records from the contentious program, documents released Wednesday revealed. The redacted documents, obtained by the ACLU in a Freedom of Information Act lawsuit, do not indicate how many records NSA improperly collected in the October breach, nor which telecommunications provider submitted the improper data. "These documents provide further evidence that the NSA has consistently been unable to operate the call detail record program within the bounds of the law," the ACLU said in a letter to Congress this week lobbying for an end to the program. The letter says elements within the Office of the Director of National Intelligence concluded the October violations had a "significant impact" on privacy and civil rights, but that the Americans affected were not told of the breach.

    • The head of the NSA got in front of congress and said they werent collecting data on every American when in fact they were. It was a straight up lie, from a dishonest fuck.

      These people are not to be believed. Not when they say they dont collect data on Americans, not when they say Trump colluded with Russians, and most definitely not when they say their mission is to protect you.

        People have a naturally optimistic streak, especially basically honest people who don't normally lie. They tend to assume the same of others. Especially of their leaders.

        This optimism is what allows liars like this to maintain their positions of power. The objective among us, who say "liar" when we hear a lie, and who remind people of an office-holder's previous lies, are called cynics. But we aren't. We are just facing reality.

    All warrantless domestic spying is improper and illegal.
    Disband the NSA and imprison the people involved.
    We have a CIA and FBI for these things. The NSA is just a money sink trying to justify it's existence by demonizing the US.

      Time to add the US to the list of rouge states that abuses its own population, and push for regime change. Maybe interfere with their elections to make sure the "right" candidate wins.

  • There's little doubt in my mind they have a full feed of absoloutely and utterly every possible thing you could imagine here, what they're in trouble for is "Dave, you're not allowed to capture data from column B on the spreadsheet and D and F only A, C, E and the entire rest in fact, but you can see here, you're still accidentally capturing data from column D due to this script here, we have to fix it or we *could* get in trouble for being naughty"

      A couple years ago in court, the DOJ argued that copying (seizing) and searching all traffic through automated means is not a search or seizure under the 4th amendment because no human actually did the seizing and searching. The court upheld this so I assume all data is copied and stored (seized) and searched.
