Max Is Getting Ready For Its Own Password-Sharing Crackdown (theverge.com) 42

Max will begin a gradual password-sharing crackdown with "soft messaging" over the next few months, with a potential price increase to follow. The Verge reports: During Warner Bros. Discovery's Q3 earnings call on Thursday, chief financial officer Gunnar Wiedenfels said this initial rollout would be followed by more progress in 2025 and 2026. Wiedenfels called password sharing "a form of price rises," as the company is "asking members who have not signed up, or multi-household members to pay a little bit more." This isn't the first time we've heard about Max's interest in password sharing, but now we have more details about when -- and how -- it will all begin. [...]

Wiedenfels didn't rule out the possibility of a Max price increase, either. He said that the "premium nature" of the service leaves "a fair amount of room to continue to push a price we've been judicious about." Max last raised prices across its ad-free plans in June.

US Cellular To Sell Some Spectrum Licenses To AT&T For $1 Billion (reuters.com) 2

U.S. Cellular has agreed to sell $1.02 billion worth of spectrum licenses to AT&T as part of its strategy to monetize its spectrum assets that were not included in an earlier $4.4 billion deal with T-Mobile. Reuters reports: Last month, U.S. Cellular agreed to sell select spectrum licenses for $1 billion to Verizon. It also signed deals with two other mobile network operators, but did not disclose the details. The latest agreement "adds a fourth mobile network operator, in addition to T-Mobile, to the list of those whose subscribers will benefit from the sale of our spectrum licenses," U.S. Cellular CEO Laurent Therivel said on Thursday. From a press release: Following this transaction, as well as those previously announced, UScellular will have reached definitive agreements to monetize approximately 55%, measured on a MHz-Pops basis, of the spectrum holdings (excluding mmWave) that were excluded from the proposed sale to T-Mobile, for a total consideration of approximately $2.02 billion. Including the proposed T-Mobile transaction, UScellular will have reached agreements to monetize approximately 70% of its total spectrum holdings (excluding mmWave), measured on a MHz-Pops basis.

"After our proposed sales, we will be left with 1.86 billion MHz-Pops of low and mid-band spectrum, as well as 17.2 billion MHz-Pops of mmWave spectrum, with the substantial majority of retained value in the C-band spectrum," [said Laurent C. Therivel, President and CEO]. "The C-band licenses have a number of attributes that we believe are favorable to their long-term value. First, our C-band licenses are positioned in an attractive mid-band frequency that can deliver outstanding speed and capacity. Second, there is a substantial 5G ecosystem of equipment vendors and existing infrastructure that uses C-band. Finally, they have a lengthy build-out timeline, with first and second build-out dates of 2029 and 2033, respectively. This provides ample time and optionality for us to either monetize or deploy the spectrum in the future. We will continue to look for ways to opportunistically monetize the C-band, as well as the other remaining spectrum."

From a report: "We should accelerate research and development to ensure our standing as an indispensable member of the global semiconductor supply chain," Taiwan Semiconductor Manufacturing Co. Senior Vice President Cliff Hou said in remarks delivered in his role as chairman of the Taiwan Semiconductor Industry Association on Thursday. "We are also working with the government to see whether we can attract foreign partners to set up design and materials centers in Taiwan."

The self-governing island, home to the world's biggest contract chipmaker, TSMC, lives with the constant threat of invasion by China, which considers it a breakaway territory. The imminent change in US leadership may alter its standing in global affairs. While President Joe Biden has repeatedly voiced unequivocal support for Taiwan, Trump said the island should pay the US for defending it, calling Xi Jinping "a very good friend of mine until Covid" in an interview with Bloomberg.

Hou, a 27-year TSMC veteran who obtained his doctorate in the US, added that Taiwan must also aim to develop more expertise in equipment and materials, areas that are dominated by foreign businesses. Intel Sued Over Raptor Lake Voltage Instability (theregister.com) 58

Intel faces a class-action lawsuit alleging its 13th and 14th generation desktop processors from 2022 and 2023 are defective, causing system instability and frequent crashes. The suit claims that Intel knew of the issue but continued marketing the processors anyway. The Register reports: The plaintiff, Mark Vanvalkenburgh of Orchard Park, New York, purchased an Intel Core i7-13700K from Best Buy in January 2023, according to the complaint [PDF]. "After purchasing the product, Plaintiff learned that the processor was defective, unstable, and crashing at high rates," the complaint claims. "The processor caused issues in his computer, including random screen blackouts and random computer restarts. These issues were not resolved even after he attempted to install a patch issued by Intel for its 13th Generation processors."

The potential class-action lawsuit cites various media reports and social media posts dating back to December 2022 that describe problems with Intel's 13th and 14th generation processors, known as Raptor Lake. These reports document unexplained failures and system instability, as well as a higher-than-expected rate of product returns. "By late 2022 or early 2023, Intel knew of the defect," the complaint says. "Intel's Products undergo pre-release and post-release testing. Through these tests, Intel became aware of the defect in the processors." And because Intel continued making marketing claims touting the speed and performance of its products, with no mention of any defect, the complaint alleges that Intel committed fraud by omission, breached implied warranty, and violated New York General Business Law.

German Firms' 4-Day Workweek Trial Slashes Stress, Keeps Productivity High (dw.com) 72

A six-month German pilot of a four-day workweek across 45 companies demonstrated that most employees experienced reduced stress and maintained productivity, with some companies adopting optimized processes and digital tools to enhance efficiency. The report says 70% of the firms plan to continue the model. DW News reports: Earlier this year, some 45 German firms launched a 4-day workweek project to find out if such a fundamental change to how we work can achieve positive results for employers and employees. For six months, and closely watched by researchers from Munster University in Germany, the volunteer companies allowed their employees to work fewer hours without reducing their salaries. The pilot run was initiated by Berlin-based management consultancy, Intraprenor, in collaboration with the nonprofit organization 4 Day Week Global (4DWG). [...]

Julia Backmann, the scientific lead of the pilot study, says employees generally felt better with fewer hours and remained just as productive as they were with a five-day week, and, in some cases, were even more productive. Participants reported significant improvements in mental and physical health, she told DW, and showed less stress and burnout symptoms, as confirmed by data from smartwatches tracking daily stress minutes. According to Backmann's findings, two out of three employees reported fewer distractions because processes were optimized. Over half of the companies redesigned their meetings to make them less frequent and shorter, while one in four companies adopted new digital tools to boost efficiency. "The potential of shorter working hours seems to be stifled by complex processes, too many meetings, and low digitalization," said Carsten Meier from Intraprenor.

The study has also shown that participants were more physically active during the 4-day workweek, and they slept an average of 38 minutes more per week than those in the five-day control group. However, monthly sick days only dropped slightly, a statistically insignificant difference compared to the same period a year ago. Marika Platz from Munster University, who analyzed the data, said she was surprised at the number of sick days because similar studies in other countries showed a significant reduction. Another surprise, she told DW, was the lack of environmental benefits from reduced working hours during the German test as other countries reported a positive impact from offices that could be shut down completely for one day, and fewer commutes to work that resulted in higher energy savings. The reason for this was probably that some German employees took advantage of the long weekends to travel, she said, which reduced any potential energy savings.
Study director Backmann stressed that the study was not about advocating for a blanket rollout of the 4-day workweek across all sectors, but rather exploring "an innovative work-time model and its effects."

Carsten Meier from the Intraprenor consultancy added that the positive results of the trial cannot be "automatically translated" into similar gains for every company in Germany.

Facebook Asks US Supreme Court To Dismiss Fraud Suit Over Cambridge Analytica Scandal (theguardian.com) 23

The justices heard arguments in Facebook's appeal of a lower court's decision allowing the 2018 class action suit led by Amalgamated Bank to proceed. The suit seeks unspecified monetary damages in part to recoup the lost value of the Facebook stock held by the investors. It is one of two cases coming before them this month -- the other one involving artificial intelligence chipmaker Nvidia on 13 November -- that could lead to rulings making it harder for private litigants to hold companies to account for alleged securities fraud.

At issue is whether Facebook broke the law when it failed to detail the prior data breach in subsequent business-risk disclosures, and instead portrayed the risk of such incidents as purely hypothetical. Facebook argued in a supreme court brief that it was not required to reveal that its warned-of risk had already materialized because "a reasonable investor" would understand risk disclosures to be forward-looking statements. The conservative justice Samuel Alito asked Shanmugam: "Isn't it the case that an evaluation of risks is always forward-looking?" "It is. The plaintiffs accused Facebook of misleading investors in violation of the Securities Exchange Act, a 1934 federal law that requires publicly traded companies to disclose their business risks. They claimed the company unlawfully withheld information from investors about a 2015 data breach involving British political consulting firm Cambridge Analytica that affected more than 30 million Facebook users. Edward Davila, a US district judge, dismissed the lawsuit but the San Francisco-based ninth US circuit court of appeals revived it. The supreme court's ruling is expected by the end of June.

Although Pichai didn't specifically mention the protests or the Israel-Hamas war, he concluded that the $1.92 trillion company "is a business, and not a place to act in a way that disrupts coworkers or makes them feel unsafe, to attempt to use the company as a personal platform." "We have a duty to be an objective and trusted provider of information that serves all of our users globally," Pichai continued. "When we come to work, our goal is to organize the world's information and make it universally accessible and useful. "I can tell you both of those are not true. You know, this was not a cost play for us. This is very much about our culture and strengthening our culture," he said.

The Hyperloop Lives On As a 1/12th Scale Model In Switzerland (theverge.com) 34

Last December, Hyperloop One, the futuristic transportation company pursuing Elon Musk's dream of tube-based, airplane-speed travel, announced its shutdown. However, the concept itself has found a new lease on life in a scaled-down version overseas. According to The Verge's Andrew J. Hawkins, "The hyperloop, in fact, lives on -- as a 1/12th scale model in Switzerland." From the report: Sure, this isn't exactly the full realization of Musk's 2013 white paper, in which he theorized that aerodynamic aluminum capsules filled with passengers or cargo could be propelled through a nearly airless tube at speeds of up to 760mph. These tubes, either raised on pylons or sunk beneath the earth, could be built either within or between cities. Musk called it a "fifth mode of transportation" and argued it could help change the way we live, work, trade, and travel. The idea is being put to the test in Lausanne, Switzerland, where a 120-meter circular test track is being operated by a team that includes the Federal Institute of Technology Lausanne (EPFL), the School of Business and Engineering Vaud (HEIG-VD), and Swisspod Technologies. This week, the group announced that it had conducted "the longest" hyperloop test of its kind: traveling 11.8 km (7.3 miles) at a speed of 40.7km/h (25.3mph).

The circular test track has a circumference of 125.6 meters (412 feet) and a diameter of 40 centimeters (15.7 inches). It sounds modest, but the group claims that in a full-scale system, their test "directly translates" to a journey of 141.6 km (88 miles), which is about the distance between Geneva and Bern, or San Francisco to Sacramento, and speeds of up to 488.2 km/h (303.4mph). The project is called LIMITLESS, which stands for Linear Induction Motor Drive for Traction and Levitation in Sustainable Hyperloop Systems. During the test, the team "monitored the performance of vital subsystems," including propulsion, communication infrastructure, power electronics, and thermal management. They assessed "energy consumption, thrust variations, [linear induction motor] response, and control during acceleration, cruising, coasting, and braking scenarios."

Of course, a 1/12th-scale circular test track is hardly a sign that the hyperloop is alive and well. Most of the startups and companies pursuing a full-scale hyperloop have shut down, victims of financial mismanagement, as well as infrastructure and regulatory hurdles. Critics said that while the hyperloop may be technically feasible, it still only amounts to vaporware. It's been called a "utopian vision" that would be financially impossible to achieve. But the Swiss team is undeterred, promising to conduct a battery of future tests to further validate the system. Swisspod CEO Denis Tudor said the group plans to test its first freight product soon, and is currently building a larger test track in the US. "This is a key step toward making hyperloop for passengers a reality and changing how we connect, work, and live," he said.

Apple has warned investors that future products may never be as profitable as its iPhone business, as it pushes into unproven new markets such as artificial intelligence and virtual reality headsets. From a report: The iPhone maker added the new warning on growth and profit margins to its latest annual report, in the list of "risk factors" facing the tech group's business.

"New products, services and technologies may replace or supersede existing offerings and may produce lower revenues and lower profit margins," Apple said, "which can materially adversely impact the company's business, results of operations and financial condition." Apple routinely warns investors in its annual reports that competition, foreign exchange, supply chain issues and other factors can put "volatility and downward pressure" on its margins. The same 10-K regulatory filing in previous years suggested that new product introductions could have "higher cost structures." But until now, Apple has not been so direct in addressing the financial profile of its future products.

Perplexity CEO Offers To Replace Striking NYT Staff With AI (techcrunch.com) 52

An anonymous reader quotes a report from TechCrunch: The CEO of AI search company Perplexity, Aravind Srinivas, has offered to cross picket lines and provide services to mitigate the effect of a strike by New York Times tech workers. The NYT Tech Guild announced its strike Monday, after setting November 4 as its deadline months earlier. The workers represented provide software support and data analysis for the Times, on the business side of the outlet. They have been asking for an annual 2.5% wage increase and to cement a current two days per week in-office expectation, among other things. [...] Picketers demonstrated in front of the NYT building in New York as negotiations continued. Meanwhile, on X, formerly known as Twitter, Perplexity's CEO offered to step in for the striking workers.

Replying to Semafor media editor Max Tani quoting the publisher, Srinivas wrote: "Hey AG Sulzberger @nytimes sorry to see this. Perplexity is on standby to help ensure your essential coverage is available to all through the election. DM me anytime here." Many on X immediately castigated Srinivas for acting as a scab -- a derogatory term for people willing to perform the jobs of striking workers. It is widely considered a disreputable behavior in matters of labor and equity. By undercutting collective action, scabs limit the ability of workers to bargain with those in positions of power. Srinivas may simply be trying to make sure people have the information they need on election day. The company has lately unveiled its own elections info hub and map. But to offer its services explicitly as a replacement for striking workers was bound to be an unpopular move.

Though TechCrunch asked Perplexity for comment, Srinivas responded to TechCrunch's post on X saying that "the offer was *not* to 'replace' journalists or engineers with AI but to provide technical infra support on a high-traffic day." The striking workers in question, however, are the ones who provide that service to the NYT. It's not really clear what services other than AI tools Perplexity could offer, or why they would not amount to replacing the workers in question.

The Los Angeles County suit alleges — in a vein similar to that of [California attorney general] Bonta's suit against Exxon Mobil — that the global beverage companies misrepresented the environmental impact of their plastic bottles, "despite knowing that plastics cannot be readily disposed of without associated environmental impacts."

"Coke and Pepsi need to stop the deception and take responsibility for the plastic pollution problems" their products are causing, said Los Angeles County Board of Supervisors Chair Lindsey P. Horvath... Currently, just 9% of the world's plastics are recycled. The rest ends up being incinerated, sent to landfills, or discarded on the landscape, where they are often flushed into rivers or out to sea. At the same time, there is growing concern about the health and environmental consequences of microplastics — the bits of degraded plastic that slough off as the product ages, or is used, or washed. The tiny particles have been detected in every ecosystem on the planet that has been surveyed, as well as nearly every living organism examined... According to the county's statement, the two companies have consistently ranked as the world's "top plastic polluters...."

The beverage maker lawsuit was filed in Los Angeles Superior Court by County Counsel Dawyn R. Harrison on behalf of the people of the state of California... "The goal of this lawsuit is to stop the unfair and illegal conduct, to address the marketing practices that deceive consumers, and to force these businesses to change their practices to reduce the plastic pollution problem in the County and in California," Harrison said in a statement. "My office is committed to protecting the public from deceptive business practices and holding these companies accountable for their role in the plastic pollution crisis."

What Happened After Remote Workers Were Offered $10,000 to Move to Tulsa? (seattletimes.com) 115

Five years ago remote workers were offered $10,0000 to move to Tulsa, Oklahoma for at least a year. Since then roughly 3,300 have accepted the offer, according to the New York TImes. [Alternate URL here.] But more importantly, now researchers are looking at the results: Their research, released this month, surveyed 1,248 people — including 411 who had participated in Tulsa Remote and others who were accepted but didn't move or weren't accepted but had applied to the program — and found that remote workers who moved to Tulsa saved an average of $25,000 more on annual housing costs than the group that was chosen but didn't move... Nearly three-quarters of participants who have completed the program are still living in Tulsa. The program brings them together for farm-to-table dinners, movie nights and local celebrity lectures to help build community, given that none have offices to commute to.
The article says every year the remote workers contribute $14.9 million in state income taxes and $5.8 million in sales taxes (more than offsetting the $33 million spent over the last five years). And additional benefits could be even greater. "We know that for every dollar we've spent on the incentive, there's been about a $13 return on that investment to the city," the program's managing director told Fortune — pointing out that the remote workers have an average salary of $100,000. The Tulsa-based George Kaiser Family Foundation — which provides the $10,000 awards — told the New York Times it will continue funding the program "so long as it demonstrates to be a community-enhancing opportunity." And with so much of the population now able to work remotely, the lead author on the latest study adds that "Every heartland mayor should pay attention to this..."

Millions of U.S. cellphone users could be vulnerable to Chinese government surveillance, warns a Washington Post columnist, "on the networks of at least three major U.S. carriers."

They cite six current or former senior U.S. officials, all of whom were briefed about the attack by the U.S. intelligence community. The Chinese hackers, who the United States believes are linked to Beijing's Ministry of State Security, have burrowed inside the private wiretapping and surveillance system that American telecom companies built for the exclusive use of U.S. federal law enforcement agencies — and the U.S. government believes they likely continue to have access to the system.... The U.S. government and the telecom companies that are dealing with the breach have said very little publicly about it since it was first detected in August, leaving the public to rely on details trickling out through leaks...

The so-called lawful-access system breached by the Salt Typhoon hackers was established by telecom carriers after the terrorist attacks of Sept. 11, 2001, to allow federal law enforcement officials to execute legal warrants for records of Americans' phone activity or to wiretap them in real time, depending on the warrant. Many of these cases are authorized under the Foreign Intelligence Surveillance Act (FISA), which is used to investigate foreign spying that involves contact with U.S. citizens. The system is also used for legal wiretaps related to domestic crimes.

It is unknown whether hackers were able to access records about classified wiretapping operations, which could compromise federal criminal investigations and U.S. intelligence operations around the world, multiple officials told me. But they confirmed the previous reporting that hackers were able to both listen in on phone calls and monitor text messages. "Right now, China has the ability to listen to any phone call in the United States, whether you are the president or a regular Joe, it makes no difference," one of the hack victims briefed by the FBI told me. "This has compromised the entire telecommunications infrastructure of this country."

The Wall Street Journal first reported on Oct. 5 that China-based hackers had penetrated the networks of U.S. telecom providers and might have penetrated the system that telecom companies operate to allow lawful access to wiretapping capabilities by federal agencies... [After releasing a short statement], the FBI notified 40 victims of Salt Typhoon, according to multiple officials. The FBI informed one person who had been compromised that the initial group of identified targets included six affiliated with the Trump campaign, this person said, and that the hackers had been monitoring them as recently as last week... "They had live audio from the president, from JD, from Jared," the person told me. "There were no device compromises, these were all real-time interceptions...." [T]he duration of the surveillance is believed to date back to last year.

Several officials told the columnist that the cyberattack also targetted senior U.S. government officials and top business leaders — and that even more compromised targets are being discovered. At this point, "Multiple officials briefed by the investigators told me the U.S. government does not know how many people were targeted, how many were actively surveilled, how long the Chinese hackers have been in the system, or how to get them out."

But the article does include this quote from U.S. Senate Intelligence Committee chairman Mark Warner. "It is much more serious and much worse than even what you all presume at this point."

One U.S. representative suggested Americans rely more on encrypted apps. The U.S. is already investigating — but while researching the article, the columnist writes, "The National Security Council declined to comment, and the FBI did not respond to a request for comment..." They end with this recommendation.

Can Heat Pumps Still Save the Planet from Climate Change? (msn.com) 310

"One technology critical to fighting climate change is lagging," reports the Washington Post, "thanks to a combination of high interest rates, rising costs, misinformation and the cycle of home construction. Adoption of heat pumps, one of the primary ways to cut emissions from buildings, has slowed in the United States and stalled in Europe, endangering the switch to clean energy.

"Heat pump investment in the United States has dropped by 4 percent in the past two years, even as sales of EVs have almost doubled, according to data from MIT and the Rhodium Group. In 13 European countries, heat pump sales dropped nearly in half in the first half of 2024, putting the European Union off-track for its climate goals." "Many many markets are falling," said Paul Kenny, the director general of the European Heat Pump Association. "It takes time to change people's minds about a heating system." Heat pumps — essentially air conditioners that can also work in reverse, heating a space as well as cooling it — are crucial to making buildings more climate-friendly. Around 60 percent of American homes are still heated with furnaces running on oil, natural gas, or even propane; to cut emissions from homes, all American houses and apartments will need to be powered by electricity...

In the United States, experts point to lags in construction, high interest rates, and general belt-tightening from inflation... [Cora Wyent, director of research for the electrification advocacy group Rewiring America] added, heat pumps are still growing as a share of overall heating systems, gaining ground on gas furnaces. In 2023, heat pumps made up 55 percent of all heating systems sold, while gas furnaces made up just 45 percent. "Heat pumps are continuing to increase their total market share," she said.

Homeowners may also run into trouble when trying to find contractors to install heat pumps. Barton James, the president and CEO of the Air Conditioning Contractors of America, says many contractors don't have training on how to properly install heat pumps; if they install them incorrectly, the ensuing problems can sour consumers on the technology... In the United States, low gas prices also make the economics of heat pumps more challenging. Gas is around three times cheaper than electricity — while heat pumps make up most of that ground with efficiency, they aren't the most cost-effective option for every household.

The Post also spoke to the manager for the carbon-free buildings team at the clean energy think tank RMI. They pointed out that heating systems need to be replaced roughly every 15 years — and the next cycle doesn't start until 2035.

The article concludes that "even with government policies and subsidies, many parts of the move to clean energy will require individual people to make changes to their lives. According to the International Energy Agency, the number of heat pumps will have to triple by 2030 to stay on track with climate goals. The only way to do that, experts say, is if incentives, personal beliefs, and technology all align."

The Washington Post reports that a former Etsy CEO remodeled their home into what's known as a passive house. It's "designed to be as energy efficient as possible, typically with top-notch insulation and a perfect seal that prevents outside air from penetrating the home; air flows in and out through filtration and exhaust systems only."

Their benefits include protection from pollution and pollen, noise insulation and a stable indoor temperature that minimizes energy needs. That translates to long-term savings on heating and cooling.

While the concept has been around for about 50 years, experts say that the United States is on the cusp of a passive house boom, driven by lowered costs, state-level energy code changes and a general greater awareness of — and desire for — more sustainable housing... Massachusetts — which alongside New York and Pennsylvania is one of the leading states in passive house adoption — has 272 passive house projects underway thanks to an incentive program, says Zack Semke [the director of the Passive House Accelerator, a group of industry professionals who aim to spread lessons in passive house building]. Consumer demand for passive houses is also increasing, says Michael Ingui, an architect in New York City and the founder of the Passive House Accelerator... The need to lower our energy footprint is so much more top-of-mind today than it was 10 years ago, Ingui says, and covid taught us about the importance of good ventilation and filtered fresh air. "People are searching for the healthiest house," he says, "and that's a passive house...."

These days, new passive houses are usually large, multifamily apartment buildings or high-end single-family homes. But that leaves out a large swath of homeowners in the middle. To widen passive house accessibility to include all types of people and their housing needs, we need better energy codes and even more policies and incentives, says In Cho, a sustainability architect, educator and a co-founder of the nonprofit Passive House for Everyone! Passive houses "can and should serve folks from all socioeconomic backgrounds," she says. Using a one-two punch of mandates for energy efficient buildings and greater awareness to the public, that increased demand for passive houses will lead to more supply, Cho says. And we're already seeing those changes in the market.

Take triple-pane windows, for example, which are higher performing and more insulating than their double-pane counterparts. Even just 10 to 20 years ago, the difference in price between the two was high enough to make triple-pane windows cost-prohibitive for a lot of people, Cho says. Over the years, as the benefits of higher performing windows became more well-known, and as cities and states changed their energy codes, more companies began producing better windows. Now they're basically at price parity, she says. If we keep pushing for greater awareness and further policy changes, it's possible that all of the components of passive house buildings could follow that trend.

"For large multifamily projects, we're already seeing price parity in some cases, Semke says...

"But as it stands, single-family passive houses are still likely to cost a margin more than non-passive houses, he says. This is because price parity is easier to achieve when working at larger scales, but also because many of the housing policies and incentives encouraging passive house buildings are geared toward these larger projects."
