FBI's Behavioral Analysis Program and Secret FISA Court 5

AftanGustur writes "Everybody should be familiar with FBI's Carnivore by now and the possibilities of abuses that come with it. An interesting article on Cryptome gives an example of what can happend when you are monitored 24 hours a day and then manipulated into committing a crime.. It also tells about the existance of the Secret FISA Court that FBI has regularly used to get permission for wiretaps and monitoring, and also the FBI's Behavioral Analysis Program. Interesting read for everyone." The FISA court is an abomination against the Constitution, and it's good to see news entities taking more of an interest in it.

    Seriously, it is a concern that just by calling this star chamber a "court" they get to claim that due process is satisfied. That does reek.

    He sounds remarkably even-tempered to me. There's certainly enough evidence to support his claim. Seems to me that the operation of this FISA "court" intentionally violates the provisions noted below:

    Amendment IV

    The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation,

    *** and particularly describing the place to be searched, and the persons or things to be seized. ***

    Amendment VI

    In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law,

    *** and to be informed of the nature and cause of the accusation; ***

    *** to be confronted with the witnesses against him; ***

    *** to have compulsory process for obtaining witnesses in his favor, ***

    *** and to have the assistance of counsel for his defense. ***

    With a court order, they can tap your internet connection, read your email, monitor your keyboard, enter your home and copy your hard drive, video tape you, audio tape you, log into your financial accounts, and monitor every last aspect of your life.
